THE FOLLOWING CONTEST IS VALID IN THE 50 UNITED STATES AND DISTRICT OF COLUMBIA (“D.C.”) ONLY. VOID ELSEWHERE AND WHEREVER PROHIBITED. SEE RULES FOR FURTHER ELIGIBILITY REQUIREMENTS. YOU MAY NOT ENTER THIS CONTEST UNLESS YOU ARE A LEGAL RESIDENT OF, AND CURRENTLY RESIDING IN, ONE OF THE 50 STATES OR D.C. THIS CONTEST WILL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. “The 2006 EXPOŽ Classroom Makeover Contest” OFFICIAL RULES NO PURCHASE NECESSARY. 1. Contest Dates/Overview: Entry into the “2006 ExpoŽ Classroom Makeover Contest” (“Contest”) begins at 12:00:00 am ET on February 1, 2006 and ends at 11:59:59 pm ET on June 1, 2006 (the “Entry Period”). The object of the Contest is for each entrant to write an original essay that describes why one of his or her teachers deserves a classroom makeover (see Rule 5 for description of "makeover"). Entries submitted to the Sponsor in accordance with these Official Rules will first be judged within the appropriate age groups (see list of groups in Rule 4) on the basis of the criteria outlined in Rule 4, below. (See rules below for further details of winner selection process and other prizes). The Grand Prize winner will win a U.S. Savings Bond and a trip and, on behalf of his/her teacher and school, supplies and other products (as described below) for the winner's teacher's classroom (provided that teacher is employed by the winner's school at the time the prize is awarded) and for other classrooms or areas of the winner's school (i.e., the school to which the winner's entry relates), as determined by Sponsor. Other prizes (described below) will be awarded to First Prize, Semi-Finalist and Finalist entries. 2. Eligibility: The Contest is open to students in grades three through twelve at the time of entry who are legal residents of the 50 United States or D.C. Entries submitted after the school year has ended at an entrant's school will be included in the age group corresponding to the grade level from which the entrant was most recently promoted. Void outside the 50 United States and D.C. and where prohibited. Employees of Sanford, its parent company, affiliates, subsidiaries, distributors, retailers, advertising and promotion agencies, and members of the immediate families or households of any of the above, are NOT eligible to participate. 3. How to Participate: To enter visit www.expomarkers.com during the Entry Period, and fill in all required information on the online entry form. Include, with your online entry, an essay of no more than 100 words (in English) describing why your teacher deserves a classroom makeover. Be sure to name your teacher in your essay. Submit your entry as instructed online. All entries must be received by the Sponsor by 11:59:59 pm ET on June 1, 2006. Limit one entry per person. Entries become the sole property of the Sponsor, Sanford LP, and will not be acknowledged or returned. Entries must be in English, and may not exceed the word limit. The entrant is the individual whose name appears on the entry form. Only one (1) entrant's name may appear on an entry form. Entry must be entrant's own original creation, executed solely by entrant and may not have won any other award. Entries may not have been published previously. Modifying, enhancing or altering a third party's preexisting work does not qualify as entrant's original creation. Entry must be in keeping with Sponsor's image and may not be offensive, as determined by the contest judges in their sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights, including but not limited to intellectual property rights, and the right to submit or use it shall not be restricted. Entries not complying in any way with these Official Rules are subject to disqualification. No correspondence regarding entries will be entered into with entrants except as provided herein. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest should virus, fraud, bugs or other causes beyond the control of the Sponsor corrupt the administration, security or proper play of the Contest. In such case, Sponsor shall determine the winners in accordance with these rules from among all valid, non-suspect qualifying entries/votes received as of the time such action was taken. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH ENTRANT AND SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. 4. Judging: All eligible entries received will first be judged within one of the following school grade groups, based on the grade level of the entrant at the time of entry (or immediately prior thereto in the case of entries submitted after the entrant's school year has ended): (a) third grade through fifth grade; (b) sixth grade through eighth grade; (c) ninth grade through twelfth grade. The entries will be judged by qualified judges based on the following criteria: Content of essay (what your teacher did to deserve a classroom makeover) (40%); emotional value (30%); and creativity (30%). On the basis of this judging, a maximum of Five-Hundred (500) entries (based on the number of qualifying entries received) will be selected and declared "First Prize winners", and each such winner will receive a First Prize as described in Rule 5. The seven (7) top-ranking entries in each grade group from among the First Prize winners will be declared "Semi-Finalists" and will be notified by e-mail and each Semi-Finalist will receive a Semi-Finalist prize as described in Rule 5 and have their essay, along with their first names and state of residency, posted online at www.expomarkers.com. The Semi-Finalist essays will again be judged according to the criteria listed above by qualified judges who were not involved in the First Prize judging. The top scoring essay from among the Semi-Finalist entries shall become the Grand Prize Winner. The second and third scoring essay from among the Semi-Finalist pool will be recognized as Finalists and receive the prize for Finalists described in Rule 5. In the event of ties in any round, the entries involved will be re-judged by a different judge who will serve as the tiebreaker. PLEASE NOTE: IF THE ENTRANT IS UNDER 13 YEARS OLD AT THE TIME OF FIRST NOTIFICATION, THE AWARDING OF THE PRIZE AND FURTHER PARTICIPATION IN THE CONTEST IS EXPRESSLY CONDITIONED UPON RECEIPT OF VERIFIABLE PARENTAL CONSENT WITHIN FIVE (5) BUSINESS DAYS OF E-MAIL NOTIFICATION. FURTHER DETAILS WILL BE INCLUDED IN THE PRIZE WINNER E-MAIL NOTIFICATION. The judging will be completed by or about August 1, 2006. All decisions of the judges shall be final in all matters relating to this contest. Please note: Sponsor reserves the right to void all votes made through any robotic, automatic, mechanical, programmed or similar duplication method and to disqualify any individual using such a method. Any attempt by any person to fraudulently circumvent the voting restrictions in order to cast multiple votes will result in disqualification of all such votes received and may result in disqualification of the entrant(s) for whom the improper votes were received if the Sponsor determines that the entrant(s) was/were involved in any way in the perpetration of such fraud. 5. Prizes. First Prizes: Up to Five-Hundred (500) First Prizes will be awarded, each consisting of two components: (a) Five-Hundred dollars cash ($500.00) or One (1) United States Series I Savings Bond ("Series I Bond") in the amount of $500.00 per First Prize winner; (Value of bond at the time it is awarded: $500.00.) and (b) one classroom makeover valued at $1,000.00 per First Prize winner, to be awarded to the school to which each First-Prize winning entry relates (i.e., the school at which the teacher referenced in the essay taught the entrant, as described in the essay) for use in improving the classroom of the teacher named in the First Prize winner's essay (provided that teacher is employed by the winner's school at the time the prize is awarded) or such winner's school's appearance, structure or curriculum, as determined by the Sponsor. Portion (b) of the prize will NOT be awarded to the winners or the teachers personally. No more than five-hundred (500) First Prizes will be awarded. The actual number awarded will depend on the number of qualifying entries received. Semi-finalists: The twenty-one (21) top-ranking entries from among the First Prize winners that are declared “Semi-Finalists” will receive the First Prize package described above and an additional $100.00 Series I Bond. Finalists: Each Finalist except the Grand Prize winner, will receive the First Prize package and the Semi-Finalist prize package and an additional $250.00 Series I Bond. Grand Prize: The school of the one (1) Grand Prize winner will receive the following: Sanford writing and marking instruments and Newell Rubbermaid products of Sponsor's choice, plus other items that may be used to improve the classroom of the teacher named in the Grand Prize winner's essay (provided that teacher is employed by the winner's school at the time the prize is awarded) and the winner's school's (i.e., the school to which the winner's entry relates) appearance, structure or curriculum. The total Approximate Retail Value (ARV) of this portion of the Grand Prize will not exceed $25,000.00. This Prize will be awarded to the school to which the Grand Prize winning entry relates (i.e., the school at which the teacher referenced in the essay taught the entrant, as described in the essay) and NOT to the winner or the teacher personally. The principal or other authorized representative of the school must accept the prize on the school's behalf, designate any additional items that might be needed to accomplish the stated purpose of the prize (subject to availability, the overall maximum prize value set forth above and Sponsor's approval), and sign any required documentation, including but not limited to a liability/publicity release. Total ARV of prize awarded to school: $25,000.00. The Grand Prize winner will receive (a) a $1,000.00 Series I Bond for him/herself (in addition to the Series I Bonds received as a First Prize winner and as a Semi-Finalist)and (b) a 4 day, 3 night trip for two to New York City (the "New York City Trip prize") at a time during the period of August 1, 2006 and August 15, 2006 during which time winner and his/her parent or guardian may be required to attend a public relations/media event for Sponsor. Winner must be accompanied by his/her parent or legal guardian. If winner is not available to travel on the designated dates, the prize trip will be forfeited and no cash value or other substitution will be awarded in its place. The New York City Trip prize includes: Round-trip coach class air travel for Grand Prize winner and one (1) parent/guardian from the major airport nearest Grand Prize winner's home (as determined by Sponsor); 3 night's hotel accommodations double occupancy. Portal to portal ground transportation to and from the public relations/media event will be provided. (If Grand Prize winner lives within 150 miles of New York, NY, roundtrip limo service will be awarded in lieu of air travel., a $200.00 per diem for meals and other incidental expenses while in New York and One Thousand Dollars ($1,000.00) cash spending money. Approximate retail value of New York City Trip prize: $5,000.00. Actual value may vary based on location of Grand Prize winner's home and airfare fluctuations. Any difference between the stated value and actual value will not be awarded. All other expenses not specifically listed above as part of the prize package will be the responsibility of the Grand Prize winner. Exact travel dates and arrangements are subject to availability and are at the discretion of the Sponsor. Grand Prize winner and guest must travel together on the same itinerary. Grand Prize winner must be available to participate in a public relations/media event on behalf of Sponsor sometime during the period between August 1 and August 15, 2006 (whether as part of the New York City Trip prize or by attendance from winner's place of residence) and shall use reasonable efforts to ensure that winner's teacher named in the winning essay makes him/herself available to participate in the event. Total maximum value of all prizes in this contest: $783,600.00 6. Prizes are non-transferable except as provided herein. No prize substitutions or cash redemptions allowed except as provided herein. Sponsor may substitute a prize (or portion thereof) of equal or greater. After the notification of First Prize winners, winners of subsequent rounds will be notified by phone, e-mail and/or overnight mail. All winners and their parents/legal guardians and teachers named in winning essays will be required to complete, notarize and return an Affidavit of Eligibility and Liability/ Publicity Release (where permitted) within fourteen (14) days of the date of notification or prize may be forfeited and an alternate winner selected on the basis of the criteria set forth herein. All prizes directed to the entrants themselves will be awarded in the winners' behalf to a parent or legal guardian who must sign all required documents and, with respect to any travel that may be involved, accompany winner on such travels. The payment of all applicable taxes including income taxes on prizes, and the determination as to whether or to what extent prizes are tax exempt, is the responsibility of the winners. 7. Submission of an entry grants Sponsor the right to use, publish, adapt, assign, edit, dispose of, and/or modify such entry in any way, in commerce and in any and all media worldwide, without limitation or compensation to the entrant, and entrants' parents or legal guardians may be required to sign a release to that effect. Submission of an entry further constitutes the entrant's parent's or legal guardian's consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the entry. Such rights, title and interest shall include, but are not limited to, all intellectual property and licensing rights. By accepting prizes, winners and winners' parents/legal guardians, teachers and schools grant Sponsor the right to use teachers', school's and winners' names, likenesses and biographical information for advertising, publicity, promotional and other purposes in commerce and in any media worldwide without limitation or additional compensation, unless prohibited by law. Sponsor assumes no responsibility for the following: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes beyond Sponsor's reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest; (iv) any entries submitted in a manner that is not expressly allowed under these rules; all such entries will be disqualified; or (v) any typographical or other errors in the printing of the offer, administration of the contest or in the announcement of the prizes and/or winners. By entering, entrants and their parents/legal guardians agree: (a) to be bound by the Official Rules; (b) that the decisions of the official judges shall be final and binding on all matters relating to the contest; and (c) to release and hold harmless the Sponsor and its parent company, affiliates, subsidiaries, divisions, advertising and promotion agencies, and all of their respective employees, directors, officers, shareholders, agents, successors and assigns (collectively “Releasees”), from and against any and all liability for any injuries, losses or damages of any kind including, without limitation, liability for personal injury, property damage or loss, caused by or resulting from or in connection with the acceptance, possession, or use/misuse of a prize, or participation in the contest or in contest-related or prize-related activities (including but not limited to travel related thereto), or the downloading or accessing of entry material. All federal, state and local laws and regulations apply. 8.
